1. Acceptance of Terms: By accessing or using the website amasettlement.com (“Site”) or engaging the services of AMA Settlement Services, Inc. (“AMA,” “we,” “our,” or “us”), you agree to be bound by these Terms of Use and all applicable laws. If you do not agree, do not use this Site or our services. AMA reserves the right to modify these Terms at any time without prior notice. Continued use constitutes acceptance of any revisions.
2. Professional Nature of Services: AMA is a neutral dispute resolution firm, not a law firm or party advocate. Our services—including appraisal, mediation, arbitration, claims consulting, and litigation support—are provided solely for neutral evaluation, facilitation, or resolution purposes. - No communication, form, or website content constitutes legal advice or creates an attorney–client, fiduciary, or confidential relationship with AMA. - AMA neutrals and personnel act exclusively in administrative or quasi-judicial capacities and are not responsible for party outcomes or legal positions. - Users should obtain independent legal or professional advice for all substantive or procedural matters.
3. Scope of Site Content: All content on this Site, including text, graphics, documents, and downloads, is provided for informational purposes only. AMA makes no guarantees as to accuracy, completeness, or fitness for a specific purpose. Use of any materials from this Site is at the user’s sole risk and discretion. AMA may update, suspend, or discontinue any part of the Site without notice and shall not be liable for any resulting damages or interruptions.
4. Confidentiality and Communications: Communications sent to AMA via this Site, email, or form submissions are not confidential unless covered by a specific written agreement with AMA. Users must not transmit privileged, sensitive, or case-specific information without prior authorization. AMA reserves the right to monitor, retain, or delete communications submitted through the Site in compliance with law and internal security procedures.

Limitation of Liability: AMA Settlement Services, Inc., its officers, employees, contractors, and neutrals shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from: - Use of this Site or reliance on its content; - Participation in any appraisal, mediation, arbitration, or claim resolution process; - Delays, decisions, or outcomes resulting from neutral determinations or party conduct; - Technical issues, data loss, or unauthorized access. All services are provided “as-is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
6. No Testimony or Compulsion: AMA neutrals, staff, and affiliates are immune from subpoena, testimony, or discovery in any litigation or proceeding arising from or relating to their roles in appraisal, mediation, arbitration, or claims resolution. Any attempt to compel testimony or disclosure constitutes a material breach of these Terms and may result in legal action and recovery of AMA’s costs and attorney fees.
7. Indemnification: Users and participants agree to indemnify, defend, and hold harmless AMA Settlement Services, Inc., its officers, agents, employees, and neutrals from and against any and all claims, liabilities, losses, damages, or expenses (including attorney fees) arising out of: - Use of this Site or services; - Breach of confidentiality, neutrality, or contractual terms; - Submission of inaccurate, unlawful, or infringing materials; - Any misuse or reliance upon neutral determinations, awards, or recommendations. This indemnity extends to actions in contract, tort, equity, or statute.
8. Intellectual Property Rights: All website content, including text, graphics, logos, and downloadable materials, is owned or licensed by AMA and protected under U.S. copyright and trademark law. Users may not copy, distribute, reproduce, or modify any material without express written consent from AMA Settlement Services, Inc.
9. Governing Law and Jurisdiction: These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law provisions. Any dispute relating to these Terms or the use of AMA’s Site or services shall be brought exclusively in the state or federal courts located in Hillsborough County, Florida. Users consent to jurisdiction and venue in those courts.
10. Termination of Access: AMA may suspend or terminate Site access or participation in any AMA-administered matter at any time, for any reason, without notice, including misuse, misconduct, or breach of confidentiality.
11. Severability: If any provision of these Terms is found unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
